Disabled sue eatery

    Two disabled persons have filed a lawsuit this week in Monongalia County Circuit Court seeking $100,000 in damages and an injunction, because La Casa Mexican Restaurant allegedly is not handicapped accessible.
    Plaintiffs Ken and Darla Ervin claim they have disabilities covered by the federal Americans with Disabilities Act.
    Named as defendants are Arbol Enterprises, owner of the 156 Clay St. restaurant, Kendal Amick, owner of the building housing La Casa, and the City of Morgantown, which approved renovation of the former warehouse on June 29, 1995, and issued a building permit.
    The Ervins allege that they were unable to have dinner at La Casa on Feb. 6, because they encountered "several steep stairs in front of the building."
    Restaurant personnel allegedly told the Ervins the only way persons in wheelchairs can enter the  restaurant is for someone to carry them up the stairs in their wheelchairs and lower them down the stairs when they leave.
    The suit states the city's building and housing code requires its chief building inspector to "make necessary inspections to see that the provisions of law "to remove illegal or unsafe conditions."
    Westover attorney Michael J. Sharley is representing the Ervins.
    The case is assigned to Judge Russell M. Clawges Jr.
