BIG WIN FOR OUR TEAM!!!


    On May 19, ADAPT of  West Virginia took a little trip to Charleston WV. to bring to light the gross violations against the civil rights of the disabled, commited by vendors of the Title XIX Waiver Progam.  As you can see our efforts got RESULTS!!!

    We need your help let us know about the problems your having in your area of WV, so the people responsable will know how there program really works.


Here are the demands...


Because of problems experienced by the disaled community in West Virginia we of ADAPT WV must take the necessary steps to insure that we have the RIGHT to control and choose the services we receive in our own home.

            1. The Medicaid Waiver Officials to monitor both case management and home health care agencies on a quarterly basis, to insure that they are in compliance with both waiver regulations and clients rights.

            2. Hold field hearings throughout the state to determine the problems with the current Title XIX Waiver and the changes which must be made to create maximum consumer choice and control.

            3. That the medicaid division of the West Virginia Department of Health and Human Services embrace and practice the 12 principles of MiCasa HR2020 in the provision and delivery of services.

            4. Secretary of Health and Human Resources Joan E. Ohl, must write a letter to West Virginia Legislature asking them to pass a resolution in support of MiCasa or HR2020.

            5. Hold a meeting with ADAPT WV before June 30th to develop a time table to initiate field hearings and planning.

            6. To develop and enforce fines and penalties for waiver providers violating the civil rights of their clients, including loss of license.


And here is their response...


            On behalf of the Bureau of Senior Services and the Department of Health and Human Resources we agree to the following actions with regard to discussions we have had with representatives of ADAPT of West Virginia.

            1.      We shall have representatives meet with representatives of ADAPT at a location appropriate for such a meeting, presumably Morgantown, in the very near future to plan for a series of hearings around the state to receive input from consumers of Medicaid Waiver services.

            2.       Once an agreement is reached on how many meetings and the nature of those meetings, representatives of both the Department of Health and Human Resources and the Bureau of Senior Services will be in attendance.

            3.      Discussions will be held with representatives of Health Care Financing Administration concerning their ability and interest in participating in the hearings or in other meetings with ADAPT of West Virginia related to the Medicaid Waiver Program.

            4.      The Department of Health and Human Rescources and the Bureau of Senior Services will review the provisions of MiCasa to determine whether support for such legislation in Congress and the West Virginia Legislature will be provided by the two agencies.


This agreement was signed by David W. Forinash, Deputy Secretary-DHHR, and Patricia F. Bradford, Commissioner Bureau of Senior Services.
