On October 8, 1998 Dan Hedges filed a motion in the United States distract court in charleston to block the Department of Health and Human Resources attempt to vacate the medley court decree. It is DHHRs position that they have substantially met the items set fourth in the decree.
Substantial reasons to maintain the decree include :
1. The need to focus attention on the existing legal duty to provide services to the medley class members.
2. The serious lack of case management and need for continual advocacy
3. The outstanding unmet needs
4. The failure to comply with the treatment team process required by the state.
5. The failure to implement a meaningful plan for service to the at-risk population.
