IMPORTANT POINTS FOR MEDICAID RENEWAL
POST HEARINGS UPDATE
1. Maximum control to select, manage and control their attendant services.
2. Attendant services must be community-based, non-institutional.
3. Eligibility based on functional need, rather than solely on age or medical diagnosis of disability.
4. Emergency access to waiver programs.
5. Services must be available in other locations, including out of town trips and vacations
6. All waiver participants must have the option to interview and choose their own homemaker/staff.
7. Delivery of service must include vouchers, direct cash payment, individual provider model, as well as consumer-directed agency model.
8. Assistive technology be included in the waiver.
9. Waiver expenditures be holistic in approach, addressing not only physical needs, but also recreational, social and spiritual needs.
10. A committee made up of at least 60% waiver users, to review all waiver policies and procedures.
11. This committee be given the responsibility of reviewing the medicaid transition plan required by the Americans with Disabilities Act.
12. Develop requirements, to ensure that all waiver vendors have consistent consumer-driven policies across the state.
13. Develop mandatory ADA self-evaluation for waiver programs that promote integrated settings.
14. State-conducted quarterly on-site evaluation of all waiver vendors.
15. Develop and enforce fines and penalties for waiver providers violating the civil rights of their clients, including loss of license.
16. Attendants should be paid a livable wage and have benefits.
17. Secretary of Health and Human Resources Joan Ohl, must write a letter to the West Virginia Legislature asking them to pass a resolution in support of MiCasa (HR 20/20).
18. Medicaid division of the West Virginia Department of Health and Human Resources embrace and practice the twelve principles of MiCasa (bill no. HR 20/20) in the provision and delivery of services.
19. Participants be given a card with a clear and concise explanation of their rights, along with the direct phone numbers of state officials responsible for the program, i.e. Susan Hogg, David Forinash and Steve Wiseman
20. Information about waiver programs to be disseminated in a variety of ways including the Internet, consumer-directed books, and information packets for new participants.
